These Terms of Service ("Terms") govern your access to and use of the mxping website, dashboard, and email validation API (collectively, the "Service"). By creating an account, generating an API key, or otherwise using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.
1. The Service
mxping provides a programmatic email verification service that performs syntax, domain and MX checks and returns a validation result. The Service is provided on a subscription basis with monthly verification quotas that depend on your plan. We may add, change, or remove features over time.
2. Accounts and API keys
You are responsible for maintaining the confidentiality of your account credentials and API keys, and for all activity that occurs under them. You must notify us promptly of any unauthorized use. API keys are issued to you and may not be shared with third parties except as part of your own application.
3. Acceptable use
You agree not to use the Service to:
- verify email addresses you do not have a lawful basis to process, including lists obtained without consent or in violation of anti-spam laws;
- send unsolicited bulk email, facilitate spam, phishing, or harvesting of personal data;
- attempt to reverse engineer, overload, probe, or circumvent rate limits, quotas, or security controls of the Service;
- resell or sublicense the Service except as expressly permitted; or
- violate any applicable law or the rights of any third party.
You are solely responsible for ensuring that your collection and processing of email addresses complies with applicable data protection laws (including the GDPR and CCPA) and that you have a lawful basis to submit any address to the Service.
4. Fees and billing
Paid plans are billed in advance on a recurring monthly basis through our payment processor, Stripe. By subscribing, you authorize us to charge the payment method on file. Fees are non-refundable except where required by law. We may change pricing on prospective renewal terms with reasonable notice. You can cancel at any time from the billing portal; cancellation takes effect at the end of the current billing period.
5. Quotas and rate limits
Each plan includes a monthly verification quota and a per-minute rate limit. Requests exceeding your quota or rate limit may be rejected. We may throttle or suspend usage that threatens the stability of the Service.
6. Service availability
We strive to keep the Service available but do not guarantee uninterrupted operation. The Service may be unavailable during maintenance or due to factors outside our control. Validation results depend on third-party mail servers and DNS, and we do not warrant that any result is error-free or that a given address is deliverable.
7. Intellectual property
We retain all right, title, and interest in and to the Service, including all related software, documentation, and trademarks. You retain ownership of the data you submit. You grant us a limited license to process that data solely to provide the Service.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, mxping WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
10. Indemnification
You agree to indemnify and hold mxping harmless from any claims, damages, or expenses arising out of your use of the Service or your violation of these Terms or applicable law.
11. Suspension and termination
We may suspend or terminate your access if you breach these Terms, fail to pay fees, or use the Service in a way that creates risk or legal exposure. You may stop using the Service at any time. Sections that by their nature should survive termination will survive.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Your continued use after the changes take effect constitutes acceptance.
